§terms of use
These Terms of Use ("Terms") are a legal agreement between you and Belmont Batcave LLC, a North Carolina limited liability company ("Belmont Batcave," "we," "us," or "our"), covering your use of belmontbatcave.com and everything on it (the "Site"). By using the Site, you agree to these Terms. If you don't agree, please don't use the Site.
01Who we are
Belmont Batcave is an independent alternative store, vendor collective, and music venue in Belmont, North Carolina, operated by Belmont Batcave LLC. The Site is informational: it tells you about the store, our vendors, our events, lets you join our newsletter, and lets makers apply to vend.
02Using the Site
You agree to use the Site lawfully and not to:
- break any law or these Terms, or use the Site for any fraudulent or harmful purpose;
- submit false information, impersonate anyone, or spam our forms;
- upload anything that infringes someone else's rights, is unlawful, malicious, or that contains malware;
- attempt to access non-public areas, probe or test the security of the Site, scrape it at scale, or interfere with its normal operation.
03Vendor applications & submissions
When you submit a vendor application or upload images, you confirm that the information is accurate and that you own or have permission to share everything you submit (including photos). You grant Belmont Batcave a non-exclusive, royalty-free license to use the content you submit for the purpose of reviewing your application and considering you as a vendor.
Submitting an application does not guarantee acceptance, a booth, shelf space, or any particular outcome. We decide who vends at our sole discretion and may decline or remove applications for any lawful reason.
04The newsletter
If you sign up for our newsletter, you're asking us to email you. You can unsubscribe at any time using the link in any email. See our Privacy Policy for how we handle your email address.
05Vendors & products
Belmont Batcave hosts independent vendors. Those vendors are responsible for their own goods, descriptions, pricing, and conduct. We don't manufacture or warrant vendor products, and references to vendors on the Site are not an endorsement or guarantee of any product. Any purchase you make from a vendor is between you and that vendor, subject to the store's in-person policies.
06Events & the venue
We host shows and events. Event details (dates, line-ups, ticketing, age policies) can change or be cancelled. When you're on our premises or at an event, you agree to follow posted rules and staff instructions and to behave safely and respectfully. To the fullest extent permitted by law, you attend events and enter the premises at your own risk.
07Intellectual property
The Site and its content — the Belmont Batcave name, logo, text, layout, and design — are owned by Belmont Batcave LLC or used with permission, and are protected by intellectual-property laws. You may view and share links to the Site, but you may not copy, reproduce, or reuse our content for commercial purposes without our written permission.
08Third-party links & embeds
The Site links to and embeds third-party services (such as Instagram, TikTok, Facebook, and map providers). We don't control those services and aren't responsible for their content, policies, or practices. Visiting them is at your own risk and subject to their terms.
09Disclaimer of warranties
The Site is provided "as is" and "as available," without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that the Site will be uninterrupted, error-free, secure, or that any information on it is complete or current.
10Limitation of liability
To the fullest extent permitted by law, Belmont Batcave LLC and its members, owners, staff, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or related to your use of (or inability to use) the Site. Nothing in these Terms limits liability that cannot be limited under applicable law.
11Indemnification
You agree to indemnify and hold harmless Belmont Batcave LLC and its members, owners, and staff from any claims, losses, or expenses (including reasonable legal fees) arising out of your misuse of the Site, your violation of these Terms, or your violation of any law or the rights of a third party.
12Governing law
These Terms are governed by the laws of the State of North Carolina, without regard to its conflict-of-laws rules. You agree that any dispute relating to the Site or these Terms will be handled exclusively in the state or federal courts located in Gaston County, North Carolina, and you consent to their jurisdiction.
13Changes & severability
We may update these Terms from time to time; the "last updated" date above will change when we do, and continued use of the Site means you accept the update. If any part of these Terms is found unenforceable, the rest stays in effect.
